St Louis Criminal Defense Lawyer: What If I Break The Terms Of My Probation?

ONLY $375 ATTORNEY FEES FOR MOST ST LOUIS MISDEMEANORS

Then a Probation Revocation hearing will be set in front of the judge. This hearing will give you a chance to convince the court that your probation should be continued into the future (so that the underlying sentence that could be assessed stays suspended). A further description is described below:

If you are charged with a crime in St Louis, then you have a couple of options. You can hire an attorney, you can take your case to trail, or you can work out some sort of deal with the local prosecutor. If you choose to work out a deal, this is called a plea bargain. A plea bargain is basically an agreement you make with the court to plead guilty, but with certain terms attached to it.

The most frequently seen example of this is what the state of Missouri calls a “Suspended Imposition of Sentence”. Let’s say you are charged with possession of marijuana (more than 35 grams). This is a Class C Felony, which can come with up to seven (7) years in jail and a $5,000 fine. But if you are able to work out a deal with the prosecutor in which an SIS is handed out, then that potential jail term and fine is “suspended”.

ONLY $750 FOR CERTAIN ST LOUIS FELONIES

In other words, if the judge grants the SIS, you will do no jail time, and pay no fine. So what’s the catch? The court puts you on a period of probation (usually between one (1) to two (2) years. And if you complete the probationary period (without any hiccups), then the original charge of marijuana possession will drop off as if it never existed (you’ll have a clean record).

But if you do anything bad during that time (like if you are caught with marijuana), then the court has the opportunity to slap the original charge back on you in full force. And the first step in that process is the Probation Revocation hearing.
